How this calculator works
If the days late are within the grace period, no fee applies. On the first day after the grace period, the initial fee is assessed: flat, a percentage of rent, or the greater of the two.
Each additional day late adds the daily fee, until the optional maximum is reached.
Formulas
Initial fee = flat, rent × %, or max(flat, rent × %)Daily days = days late − grace days − 1 (minimum 0)Total = min(cap, initial + daily days × daily fee) Assumptions & limits
- Many states and cities cap late fees, require a minimum grace period, or require fees to be "reasonable." This tool does not check legality (last reviewed 2026-10-18). Confirm your state and local rules and follow your lease.
- How days are counted (weekends, holidays, due-date conventions) depends on your lease and local law.

Frequently asked questions
How much can a landlord charge for a late fee?
It depends on your state and sometimes your city. Some states set a fixed percentage cap (often around 5% of rent), others require a grace period, and some only require the fee to be reasonable. Check your local law before setting or charging a fee.
When does a late fee start?
Usually the day after the grace period stated in the lease ends. If rent is due on the 1st with a 5-day grace period, the fee typically applies starting on the 6th.
